These Terms of Service ("Terms") govern your use of Atomic Agent, an open-source, local-first AI agent runtime, and the atomicagent.io website. Atomic Agent is provided by AtomicBot ("we", "us"). By downloading, installing, or using the software, you agree to these Terms.
1. The Software and Its License
Atomic Agent is free and open source, released under the MIT License. That license is the primary legal instrument governing your rights to use, copy, modify, and distribute the code. Where these Terms and the MIT License differ regarding the software itself, the MIT License controls. These Terms add context for use of the software and the website.
2. No Account, No Fee
Using Atomic Agent does not require an account, and we charge nothing for the software. The model runs locally on your own hardware, so there is no usage or token fee from us. You are responsible for the cost of your own hardware and any third-party services you choose to connect.
3. Your Responsibilities
Atomic Agent is a powerful automation tool: it can drive your browser, read and write files, and run shell and git commands on your machine. You are solely responsible for how you use it. In particular, you agree that you will:
- Use the agent only on systems and accounts you are authorized to access.
- Review what the agent is about to do before granting it access to sensitive files, credentials, or destructive commands.
- Comply with all applicable laws and with the terms of any third-party service, website, or API the agent interacts with on your behalf.
- Not use the agent to violate others' rights, distribute malware, or cause harm.
4. Third-Party Services and Tools
Atomic Agent can connect to external tools and services — websites, APIs, Model Context Protocol (MCP) servers, optional cloud model providers, and remote drivers. Those services are operated by third parties under their own terms and privacy policies. We are not responsible for third-party services, and your use of them is at your own risk.
5. AI Output
Output produced by the agent is generated by an AI model and may be inaccurate, incomplete, or unsuitable for your purpose. It is not professional advice. You are responsible for reviewing and verifying any output before relying on it or acting on it, especially for consequential actions.
6. Intellectual Property
The Atomic Agent source code is licensed to you under the MIT License. The "Atomic Agent" and "AtomicBot" names, logos, and brand assets remain our property and are not granted to you by the MIT License or these Terms. You retain all rights to your own data, prompts, and the outputs you generate.
7. Disclaimer of Warranties
Atomic Agent is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be uninterrupted, error-free, or secure, or that it will produce any particular result.
8. Limitation of Liability
To the maximum extent permitted by law, AtomicBot and its contributors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, or business, arising from your use of or inability to use the software — even if advised of the possibility of such damages. This reflects the nature of free, open-source software that you run yourself.
9. Indemnification
You agree to indemnify and hold harmless AtomicBot and its contributors from any claims, damages, or expenses arising out of your use of the software, your violation of these Terms, or your violation of any law or third-party right.
10. Governing Law
These Terms are governed by applicable law without regard to conflict-of-law provisions. Nothing in these Terms limits any rights you have under mandatory consumer-protection laws in your jurisdiction.
11. Changes to These Terms
We may update these Terms as the project evolves. Material changes will be posted on this page with a revised "Last updated" date. Continued use of the software after changes take effect constitutes acceptance of the updated Terms.
